Michael Flynn, Trump’s former national security adviser, has pleaded guilty to one count of lying to the FBI. Under 18 U.S. Code, Section 1001, lying to the FBI carries a sentence of up to five years in prison and/or a fine.Robert Mueller, the special counsel, has agreed to seek a sentence ranging from no time in prison to six months. The sentence will be handed down when Mueller determines the extent of Flynn’s cooperation. Under 18 U.S. Code, Section 5553, the judge doesn’t have to follow Mueller’s sentencing recommendation.
Flynn’s cooperation with investigators includes: answering questions; providing sworn written testimony; submitting to polygraph exams; and more. Flynn must also turn over any and all evidence of crimes he knows about.
